Terms of Service
Effective August 12, 2026
These terms govern your use of this website and set out the ground rules for engagements with GrowthPraetorian, a service ofHyams Digital Solutions ("we", "us").
This site is information, not an offer
Everything here describes our services and our approach. Pricing shown is a published baseline, not a quote. The work we do for you, what it costs and what it includes are defined in a written proposal and agreement signed by both of us, and that agreement governs if it says anything different from this page.
What we commit to
We commit to a defined process and to measurement you can verify yourself in your own accounts. Specifically, that means taking a full inventory of the addresses your current site answers before changing anything, planning a permanent redirect for each one, running an automated check that blocks a launch it cannot verify, and giving you a written rollback path before any DNS change.
What we do not promise
We make no guarantee about search rankings, traffic, leads, revenue or the timing of any of them. Search engines, competitors and markets are outside anyone's control, and any vendor who guarantees a position is telling you something they cannot know. Our commitment is to the work and the measurement, not to an outcome.
What you own
- Your domain stays registered in your name and in your control.
- Your content, brand assets and the material you supply remain yours.
- The website we build for you is yours, delivered as a repository you have access to.
Our own reusable tooling, packages and templates remain ours, and your engagement includes a license to use them as part of your site for as long as you like, including after the engagement ends.
What we need from you
Projects stall on access, not on effort. You agree to provide timely access to the accounts the work requires, to supply or approve content when we ask, and to make the go or no-go decision at cutover. Where access sits with a vendor being replaced, we will help, but we cannot compel a third party to release it.
Fees
Setup fees and recurring fees, their schedule and their payment terms are set out in your agreement. Recurring work continues until either side ends it under the notice terms in that agreement.
Ending an engagement
Either side may end a recurring engagement under the notice terms of the agreement. When it ends, you keep the site, the domain and the content. We will hand over what you need to host it elsewhere. Fees for work already performed remain payable.
Third-party services
Your site depends on services we do not operate, including hosting, DNS, analytics and Google's products. We are not responsible for their outages, policy changes or pricing, though we will work with you when one of them causes a problem.
Acceptable use
You agree not to use our services for unlawful content, spam, malware, infringement of anyone's rights, or anything designed to mislead the public. We may end an engagement that does.
Limitation of liability
To the extent the law allows, our total liability arising out of an engagement is limited to the fees you paid us in the twelve months before the claim, and we are not liable for indirect, incidental or consequential damages, including lost profits or lost data.
Governing law
These terms and any engagement are governed by the laws of the State of Tennessee, United States, without regard to its conflict of laws rules.
Changes
We may update these terms. Material changes get a new effective date at the top of this page. Changes do not alter a signed agreement already in effect.
